1. Introduction
Simcha SMS Inc. (“Simcha SMS,” “we,” “us,” or “our”) provides customized invitation and poster designs and opt-in text-message alerts. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit our website, place an order, use our services, or receive messages through our service.
By using our website or services, you acknowledge this Privacy Policy. Where applicable law requires consent, we will seek that consent separately; this Policy does not replace a required consent.
2. Information We Collect
Depending on how you use our services, we may collect:
- Customer details: name, email address, and, if you sign up for text messages, mobile phone number. If you order without an account, the email address and phone number you give at checkout.
- Order and event details: event date, time, venue, street address, names, invitation wording, and other details you provide for a design.
- Messages and consent records: support correspondence and chat messages, including pictures, files, and voice notes you send; SMS opt-in and opt-out records; consent records (the wording and version shown, the program, the time, the web page, what you did to opt in, and your IP address and browser); and complaints.
- Payment and transaction information: order amount, payment status, transaction identifiers, and information needed to resolve payment disputes. Payments are processed through Stripe.
- Designers: first and last name, age, phone number, payout details (QuickPay phone number or email), portfolio and uploaded designs and fonts, and earnings records. This information is visible to authorized staff only.
- Technical information: information such as IP address, browser or device information, security logs, and information necessary to operate and protect the website.
- Website storage information: cookies or local-storage data needed for sign-in, saving drafts and preferences, and core website functionality, and first-party site analytics (see section 10).
Customers submit invitation wording and other text for designs. Customers can also send pictures, files, and voice notes in support chats, and designers upload artwork and fonts.
Please do not submit sensitive personal information unless it is genuinely necessary for your order and you are authorized to provide it.
3. How We Use Information
We may use information to:
- Create, customize, preview, and deliver invitations and posters.
- Process orders and payments and maintain transaction records.
- Send service-related customer communications, including order or design updates, by email, and by text message only where the customer has opted in to SMS.
- Send opt-in text-message alerts about accounts, orders, downloads, customer support, and designer application or approval updates.
- Use a phone number given at checkout, or on a designer application only to contact you about that order, account, or application. We send it text messages only if you ticked the separate, unchecked SMS consent box.
- Review designer applications, publish approved designs, and pay designers.
- Respond to support requests, download problems, complaints, and refund or payment disputes.
- Record and honor consent withdrawals, STOP requests, and other opt-outs.
- Detect fraud, abuse, unauthorized activity, and violations of our Terms.
- Maintain website functionality, security, and reliability.
- Meet legal obligations and establish, exercise, or defend legal claims.
We do not send promotional or marketing SMS messages to customers under our current service plan.
4. Guest Lists and Third-Party Information
We do not send text messages to guests or other third parties on behalf of customers, and our service does not accept guest lists or contact-list uploads. Text messages are sent only to a person who signed up for them with their own mobile number, as described in our SMS Messaging Terms & Policy.
Customers are responsible for ensuring that information they submit about other people, such as names in invitation wording, is accurate to the best of their knowledge and that they are authorized to provide it.
Anyone who believes they received a message from us without having signed up may contact us at sales@simchasms.com about an unwanted message or privacy concern. We will suppress further messages to a complaining number while we investigate, and we will honor applicable opt-out requirements.
5. SMS Consent Information and Marketing Restrictions
We do not sell mobile phone numbers or share mobile information, SMS opt-in data, or consent records with third parties or affiliates for their own marketing or promotional purposes. These restrictions apply to messaging consent information as well as phone numbers collected through our service.
We may disclose relevant information to service providers that process it on our behalf to operate the service, such as Twilio for messaging, Stripe for payments, Supabase for our database, sign-in, and file storage, Cloudflare for website hosting, and Resend or Microsoft 365 (Outlook) for email. These providers may use information as necessary to perform their services, subject to applicable contractual and legal restrictions.
We do not authorize service providers to use SMS consent data or mobile numbers for their own marketing.
6. Payments
Payments are processed through Stripe using checkout integrated into our website. Card details are entered into fields provided by Stripe and go directly to Stripe, which may collect and process payment-card information under its own privacy and security practices.
We do not collect or store full payment-card numbers ourselves. We may retain order records, payment status, transaction references, and other limited information needed for accounting, support, fraud prevention, and disputes.
7. When We Disclose Information
We may disclose information:
- To service providers that need it to provide hosting, payment processing, SMS delivery, email or customer communications, or security services.
- When necessary to process an order, deliver a requested service, or address a support request.
- To investigate suspected fraud, abuse, unlawful messaging, or violations of our Terms.
- To comply with valid legal process or applicable law, or to protect rights, safety, and property.
- In connection with a business reorganization or transfer, subject to applicable legal requirements.
We do not sell personal information. We do not share personal information with third parties for their own marketing purposes.
8. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including delivering designs, providing support, resolving disputes, maintaining business records, and meeting legal obligations.
Completed designs and order records are retained as long as reasonably necessary for delivery, support, disputes, accounting, tax, and legal obligations. Accounts are closed by us on request (email sales@simchasms.com); closing an account removes the sign-in, while orders and designs that must be kept remain.
Anonymous website analytics are deleted after about 400 days.
We may retain limited consent, opt-out, and suppression records for as long as necessary to honor recipients' preferences, demonstrate compliance, and prevent future unwanted messages. This may require retaining a phone number or a protected representation of it even after other information has been deleted.
Backups and records retained for legal or security purposes may persist for a limited additional period.
9. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. Safeguards may include access restrictions, secure connections, appropriate password protection, and security monitoring.
No website, storage system, or transmission method can be guaranteed completely secure. We cannot promise that unauthorized access or data loss will never occur.
If we discover a security incident, we will investigate, take reasonable steps to contain and address it, secure affected systems, and provide notices when required by applicable law.
11. Children's Privacy
Our customer service and text messaging are not directed to children under 13, and we do not intend to knowingly collect personal information directly from children under 13 for their own use.
Our designer application is the one place where a young person may apply: it asks for the applicant's age and currently accepts applicants aged 10 or older. We collect that information only to review the application and pay the designer.
Invitations may name children, for example for a bris, upsheren, or bar mitzva. This wording is used only to create the invitation that was ordered.
If we learn that we have knowingly collected personal information directly from a child under 13 in circumstances requiring parental notice or consent, we will take appropriate steps to address the situation, which may include stopping the relevant collection, seeking legally required parental consent, or deleting the information where appropriate.
A parent or guardian who believes a child has provided personal information directly to us may contact sales@simchasms.com.
12. Your Privacy Choices and Requests
You may contact us to request access to, correction of, or deletion of personal information, or to raise a privacy concern. We may ask you to verify your identity or authority before acting.
We will review and respond to requests as required by applicable law. Some information may need to be retained for legal obligations, transaction records, security, dispute resolution, or consent and opt-out suppression.
To make a request, email sales@simchasms.com and describe the information or request. Please do not include payment-card numbers or other unnecessary sensitive information in your email.
13. Third-Party Services and Links
Our services rely on third-party providers, including Stripe for payments, Twilio for SMS messaging, Supabase for our database, sign-in, and file storage, Cloudflare for website hosting, and Resend or Microsoft 365 (Outlook) for email. Their processing of information may also be governed by their own privacy policies and contractual terms. We do not control the privacy practices of independent third-party websites.
14. Changes to This Policy
We may update this Policy to reflect changes in our services, technology, legal obligations, or information practices. We will post the revised version on our website and update the effective date. Where required, we will provide additional notice or obtain consent.
